MEDICAL BENEFITS –

During a divorce, the court will require that the parties maintain the health insurance coverage that they currently have in place.  As a result, the benefits during a divorce should no change.   After a divorce,  Typically, health insurance is continued for the children.  If a spouse doesn’t have health insurance available, COBRA benefits will be available.  The cost of that insurance is typically paid by the person receiving the benefit, but the court can order either party to pay the cost.  It is important to consider health insurance benefits when facing a divorce.

RETIREMENT BENEFITS –

Retirement benefits are like any other marital asset.  If they were accumulated during the marriage, they will be divided.  Often times it is difficult to get an amount of a retirement account at the time of marriage to determine the premarital portion. If there is a premarital portion, it is subtracted from the total to get the marital portion.

Social Security Benefits are not divided. The federal government grants you your benefits or an amount of one-half of your spouses benefit during the marriage if you were married 10 years or more.  It doesn’t effect the parties benefits by reducing them.
